Terms of Service
These Terms of Service ("Terms") govern your use of villie mobile application and related services (collectively, the "Service"), operated by villie ("villie," "we," "us"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to create an account or use the Service. By using the Service you represent that you are 18 or older. The Service is intended for adults; it is not directed at and not designed for minors.
2. The Service
villie is a mobile application for expecting and postpartum families. The Service includes:
- Specialist directory: a searchable list of OB/GYN, doula, midwife, lactation consultant, pediatrician, sleep coach, pelvic-floor PT, perinatal dietitian, and PPD therapist providers, with verified credentials, reviews, and integrated booking through partners.
- Milk Connect: a peer-to-peer breast-milk donor marketplace with voluntary trust badges, informed-consent gates, and optional shipping integration.
- Support rooms: private chat rooms moderated by trained community members, with AI-assisted crisis detection and an optional anonymous mode.
- Gear marketplace: a peer-to-peer used-baby-gear marketplace with built-in CPSC recall checks, barcode lookup, and a prohibited-items policy.
- Home and milestones: baby milestone tracking, daily check-ins, weekly content, brand perks, and curated events.
- Villie AI: an in-app AI companion that answers questions and provides supportive responses. Villie is not a clinician and does not provide medical advice.
3. Your account
- You are responsible for safeguarding your account credentials. Tell us immediately if you suspect unauthorized access.
- You agree to provide accurate, current, and complete information during registration and to keep it current.
- You are responsible for all activity under your account.
- One person, one account. Do not impersonate another person or misrepresent your affiliation with any person or entity.
4. Specialist directory
Specialists listed in the Service are independent third parties. villie does not employ specialists, does not guarantee the quality of any specialist's services, and does not verify clinical outcomes. Listings may include providers we have verified through the U.S. National Provider Identifier Registry; an "NPI verified" badge confirms the provider's NPI number is active, not the quality of care. Booking through the Service routes you to the provider's own scheduling system. Any clinical or therapeutic relationship is between you and the provider.
5. Milk Connect
- villie is a platform that connects donors and recipients. We are not a party to milk-sharing transactions.
- Voluntary trust badges (diet flags, medication disclosures, lifestyle attestations) are self-reported by donors and are not verified by villie.
- Recipients must complete an informed-consent acknowledgment before initiating a milk transaction.
- Donors and recipients are solely responsible for any safety screening, testing, and decisions about whether to use shared milk.
- villie expressly disclaims any warranty about the safety, quality, suitability, or fitness of any milk shared through the Service.
6. Gear marketplace
- villie is a platform for peer-to-peer transactions. We are not a party to gear sales and we do not warehouse, inspect, or sell items ourselves.
- Cash-only at MVP. Payments occur off-platform between buyer and seller (cash, Venmo, Zelle, Apple Cash, or similar) at the time of pickup. villie does not process payments for gear and provides no chargeback or buyer protection. Disputes are between the parties.
- Prohibited items. The following categories are prohibited from listing: car seats; breast pumps; sleep positioners; inclined sleepers; helmets; cribs manufactured before 2011 (drop-side ban); toys manufactured before 1978 (lead paint). Listings in these categories will be removed.
- CPSC recall enforcement. We check listings against the U.S. Consumer Product Safety Commission's SaferProducts.gov database before posting and on a nightly sweep. Listings matching active recalls are blocked from posting and withdrawn from the marketplace.
- Safe-meeting standard. Both parties acknowledge a safe-meeting checklist before entering a gear thread (public meeting place, bring a second person, inspect before paying, trust your instincts).
- Sellers represent that they own the item, that it is not subject to a recall, that they have disclosed material defects, and that the listing is accurate.
7. Support rooms and user content
- You are responsible for the content you post. Do not post content that is unlawful, harassing, defamatory, hateful, sexually explicit, threatening, or that infringes another person's rights.
- You grant villie a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and adapt your content solely to operate the Service.
- By posting, you confirm you have the right to share that content.
- AI-assisted moderation. Messages in support rooms are scanned by AI for safety concerns (suicidal ideation, postpartum depression red flags, abuse, harassment). Messages may be delayed, withheld, or routed to a human moderator. We will route users to crisis resources (988, Crisis Text Line, Postpartum Support International) when our AI detects acute risk.
- Anonymous mode. Anonymous mode is offered to support candor in vulnerable conversations. We retain the underlying linkage between alias and account solely to enforce community standards and respond to safety concerns.
- Section 230. villie is an interactive computer service under Section 230 of the U.S. Communications Decency Act. We are not responsible for user-generated content. We may, but are not obligated to, remove content that violates these Terms.
8. AI features
- The Service uses Claude AI models (provided by Anthropic) to power Villie, content moderation, daily check-in replies, weekly room digests, and milestone explainers.
- AI outputs are informational and supportive. They are not medical advice, not diagnostic, and not personalized clinical guidance.
- You should not rely on AI output for any decision that requires clinical judgment.
- Inputs to and outputs from AI features are processed under our agreement with Anthropic, which prohibits use of your data to train Anthropic's models.
9. Crisis intervention
The Service is not a crisis service. If you are in mental-health crisis or believe someone you know is, call or text 988 (U.S. Suicide and Crisis Lifeline) or text HOME to 741741 (Crisis Text Line). For postpartum-specific support, call Postpartum Support International at 1-800-944-4773. For a medical emergency, call 911.
10. Payments and fees
The Service is currently free for families. Specialist booking, milk-marketplace shipping, and brand-perk redemption may involve payments to third parties (provider, donor, brand, shipping carrier). Where villie processes a payment on your behalf, it occurs through Stripe and you agree to Stripe's terms. villie does not store full card numbers or bank details.
11. Brand perks and affiliate relationships
The Service surfaces brand perks (sample requests, discount codes, partner offers). Some perks involve affiliate relationships under which villie may receive a commission when you complete a transaction. We disclose these relationships on the perk detail screen consistent with U.S. Federal Trade Commission guidance. We do not let affiliate relationships influence which perks we show; ranking is based on your stage and feeding method, not on commission rates.
12. Acceptable use
Do not:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Harass, abuse, threaten, or impersonate another user.
- Solicit personal information from a child or attempt to make contact with a child outside the Service.
- List items prohibited by Section 6 or known to be unsafe.
- Use the Service to advertise or solicit business outside its intended marketplaces.
- Reverse engineer, decompile, or attempt to extract source code or trained model weights.
- Scrape, crawl, or otherwise collect Service content programmatically without our written permission.
- Circumvent rate limits, security controls, content moderation, or CPSC recall enforcement.
- Send unsolicited or unauthorized advertising or promotional material through the Service.
13. Termination
- You may stop using the Service at any time. To delete your account, use the in-app deletion option (when available) or contact us.
- We may suspend or terminate your account if you violate these Terms, if your conduct creates risk for other users, or if we are required to do so by law. We will provide notice where reasonable.
- Sections that by their nature should survive (intellectual property, disclaimers, limitations of liability, dispute resolution, governing law) survive termination.
14. Intellectual property
The Service, including its software, design, brand, content (other than user-generated content), and trademarks, is owned by villie or its licensors and is protected by U.S. and international intellectual-property law. You receive a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes consistent with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service.
15. DMCA and copyright
If you believe content on the Service infringes your copyright, send a notice under the U.S. Digital Millennium Copyright Act to felitrujillo95@hotmail.com with the information required by 17 U.S.C. § 512(c). We will respond consistent with the DMCA's safe-harbor procedures.
16. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE VILLAGE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ARISING FROM COURSE OF DEALING OR USAGE. THE VILLAGE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVICE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
villie does not warrant the accuracy, reliability, or safety of any user-generated content, third-party content, milk shared through Milk Connect, gear sold through the Service, or AI-generated output.
17. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE VILLAGE AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE SIX MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages, so some of these limitations may not apply to you. Nothing in these Terms limits our liability for fraud, gross negligence, or willful misconduct, or for any liability that cannot be limited under applicable law.
18. Indemnification
You agree to defend, indemnify, and hold harmless villie from any claim, damage, loss, liability, and expense (including reasonable attorneys' fees) arising from or related to (a) your use of the Service; (b) your content; (c) your violation of these Terms; (d) your violation of any law or third-party right; or (e) your interactions with other users, including milk-sharing or gear transactions.
19. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Subject to Section 20, any dispute arising out of these Terms or the Service will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction in those courts.
20. Dispute resolution
Before filing a claim, you agree to try in good faith to resolve the dispute by contacting us at felitrujillo95@hotmail.com. If we cannot resolve the dispute within 60 days, either party may pursue the dispute in court as set forth in Section 19. We do not require binding arbitration or waive class-action rights at this time.
21. Changes to these Terms
We may revise these Terms. The "Last updated" date at the top reflects the most recent version. Material changes will be communicated through the app or by email at least 14 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
22. Miscellaneous
- Severability. If any provision is found unenforceable, the remaining provisions remain in effect.
- Waiver. Our failure to enforce a right is not a waiver of that right.
- Assignment. You may not assign these Terms without our consent. We may assign them to a successor in interest.
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and villie regarding the Service.
- Notices. We may send notices to the email associated with your account or through the Service.
